The rule of law is the legal principle that law should govern a nation, as opposed to being governed by arbitrary decisions of individual government officials.
From Black’s Law Dictionary 4th Edition 1968 Preamble 1,
(American Bar Association Canons Preamble)
The continued existence of a free and democratic
society depends upon recognition of the concept
that justice is based upon the rule of law grounded
in respect for the dignity of the individual and his
capacity through reason for enlightened self-government.
Law so grounded makes justice possible,
for only through such law does the dignity of
the individual attain respect and protection. Without
it, individual rights become subject to unrestrained
power, respect for law is destroyed, and
rational self-government is impossible.
This legal principle did not spring forth with the United States Constitution 227 years ago. When researching this principle, you will find references as old as Aristotle (335 BC).
If the United States was still being governed under this principle, we would not see an 11,000 page law with 1,400 exemptions and waivers of its mandates upon implementation (The Affordable Care Act).
We would not see unelected government agencies stalling processing of applications from one perceived class of groups while continuing to process others (the IRS and 501(c)(4) applications).
We would not see the agency tasked with stopping illegal transfers of guns engaged in that very activity (Attorney General Eric Holder and ATF involvement in “Fast and Furious”).
We would not see unelected bureaucrats redefining regulations to gain further control (the EPA and “waters of the United States”).
We would not see “sanctuary cities” where enforcement of illegal immigration law is suspended (San Francisco SEC. 12H.1. CITY AND COUNTY OF REFUGE ).
A gauge of how much liberty has been stripped away from us is to consider infringements on one of the original “Bill of Rights”. When we are compelled to disarm (there are several scenarios) then you will know, we will are no longer living in the United States of America. The experiment in self-rule will be over and we will be residing in the Unilaterally Socialist America.
